Terms of Use

These Terms of Use (the Terms) govern your access to and use of coastal-labs.co.za (the Site). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Important: If you engage us for services, the signed Services Agreement / Proposal will govern that relationship and will prevail over these Terms in the event of conflict.

1) Eligibility and acceptable use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate applicable laws or regulations.
  • Infringe intellectual property or privacy rights.
  • Submit unlawful, defamatory, or harmful content.
  • Attempt to gain unauthorised access to the Site, systems, or data.
  • Interfere with the Site’s operation (e.g., load testing, scraping, malware).
  • Misrepresent your affiliation or impersonate another person.

2) Information on the Site

The Site provides general information about our business and services. Content is provided “as is” and for informational purposes only; it is not professional advice. We may update, remove, or correct content at any time without notice.

3) Enquiries and submissions

If you submit information via forms or email, you represent that you have the right to share it and that it is accurate to the best of your knowledge. Do not submit confidential or proprietary information unless we have a written NDA in place. We may contact you in response to your enquiry.

4) Intellectual property

Unless stated otherwise, all content on the Site (text, graphics, logos, design, and code) is owned by Coastal Labs or licensed to us and is protected by intellectual property laws. You may view, download, and print reasonable portions of the Site for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works without our prior written consent.

The Site may link to third-party websites or include third-party components (e.g., analytics). We do not endorse and are not responsible for third-party content, products, or services. Your use of third-party sites/tools is at your own risk and may be subject to their terms.

To the maximum extent permitted by law, Coastal Labs, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site, even if advised of the possibility of such damages.

9) Indemnity

You agree to indemnify and hold harmless Coastal Labs from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Site.

10) Suspension or termination

We may suspend or terminate access to the Site at any time, with or without notice, for any reason, including for violation of these Terms.

11) Governing law and disputes

These Terms are governed by the laws of South Africa, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts of South Africa (and specifically, where applicable, the High Court of South Africa).

12) Changes to these Terms

We may update these Terms from time to time. The updated version will be indicated by a new “Last updated” date and will be effective when posted. Continued use of the Site after changes means you accept the updated Terms.
